Legal Experts Reveal If CEO Andy Byron Can Sue Coldplay After Jumbotron ‘Kiss Cam’ Exposed His Affair With Co-Worker Kirstin Cabot

Legal Experts Reveal If CEO Andy Byron Can Sue Coldplay After Jumbotron ‘Kiss Cam’ Exposed His Affair With Co-Worker Kirstin Cabot

Chris Martin and his band Coldplay had no idea that they would make Andy Byron a household name. The band was performing in Boston last week when they sang and chatted with audience members with a camera. The camera then focused on a man standing with his arms wrapped around a woman, swaying along as they were beamed onto the big screen.

The video appears to show Astronomer CEO Andy Byron holding his company’s chief people officer, Kristin Cabot, in a way that he should’ve been holding his actual wife.

The pair would quickly separate, hiding from the camera as those around them laughed and looked pretty mortified.

In the aftermath, Byron made the decision to part ways with his company.

Data tech company Astronomer released a statement on Saturday, July 19, on social media platform X and on job networking site LinkedIn, saying, “Andy Byron has tendered his resignation, and the Board of Directors has accepted.”

Now, speculation has come up on whether Byron may look into suing Coldplay.

Unfortunately for Andy Byron, it appears he is going to have to accept his loss like a man.

Ron Zambrano of the Los Angeles-based West Coast Employment Lawyers told The Mirror: “Any legal claims from Byron would be dead on arrival. He has no grounds to sue.”

Zambrano went on: “First, it would immediately be struck down as a restriction on creative speech and Coldplay’s ability to be artistic during their performances.

“Second, Byron and Cabot waived their right to privacy when they decided to attend a public event, so their public display of affection is on them, not on Coldplay. They just got caught.”

Tre Lovell, a civil and entertainment attorney of the Lovell Firm, said much of the same.

“When you are out in public, you have no right to privacy for your actions,” he explained, adding: “People are free to photograph you and video you.”

Lovell divulged further: “What people cannot do is use the video or photographs to violate your right to publicity in terms of using your image for commercial purposes or defame you and depict you in a manner that is false or untruthful.”

Is Andy Byron Headed For Divorce?

Andy Byron, CEO of data analytics startup Astronomer, was featured on the jumbotron of a Coldplay concert snuggling up to his coworker, Kristin Cabot.

He would soon resign from his job.

Byron is married to Megan Kerrigan Byron, an educator at Bancroft School, where she serves as the Associate Director of Lower School and the Hope Graham Program Admissions. The couple lives in New York and has two children.

After Andy Byron and Kristin Cabot were captured at a Coldplay concert sharing a cozy moment, his wife made it clear that she was not happy about the situation by immediately dropping his last name on her Facebook profile.
